Mukata apeals against his conviction



UPND Chilanga Member of Parliament Keith Mukata has appealed against his conviction  saying the judge erred in law and fact .

This is according to a notice of appeal filed in the Court of Appeal Holden at Lusaka Criminal Jurisdiction.

The notice claims that  the learned trial judge erred in Law and fact when she convicted him without his supporting evidence on record to support such a conviction in.

It further suggests that  the trial judge erred in Law and fact when she convicted him based on circumstantial evidence which had more than one inference  drawn therefrom.

It states ,  other grounds will be included upon perusal and review of the entire judgments.
Yesterday Lusaka High Court Judge Susan Wanjelani sentenced Mukata to death after finding him guilty of first degree murder.

Mukata's co-accused Charmaine Musonda was however acquitted on all charges of murder.
In this matter Keith Mukata was convicted for one count of murder.

The convict murdered his Security guard Namakau Kalilakwenda who was manning his Law firm on May 6, 2017.

Judge Wanjelani said the burden to prove the case beyond doubt does not lie with the accused.
